1. Platform Definition

DownUp is an Algerian digital platform that acts as an intermediary for organizing transactions, combining an e-marketplace for buying and selling, a platform for professions and services, an intermediary payment system, a chat and agreements system, and a user verification system.

The platform does not represent a seller, buyer, or professional, and is not a direct party in any transaction between users.

2. Acceptance and Legal Eligibility

• The user must be 18 years of age or older.
• The user acknowledges their legal capacity to enter into agreements.
• Continued use of the platform means acceptance of any updates to these terms.

3. Account Creation and Information Accuracy

• The user is obligated to provide accurate, correct, and up-to-date information.
• Creating more than one account for the same person is prohibited.
• The user is responsible for protecting their login credentials.
• The platform reserves the right to request identity verification via email, phone number, official document, or selfie.
• Any false or misleading information may lead to suspension or deletion of the account without prior notice.

4. User Roles and Permissions

Accounts are divided into:

• Visitor (browsing only without registration).
• Buyer.
• Seller.
• Professional/Freelancer.

Permissions vary according to the account type, and the platform reserves the right to modify or restrict any permissions as needed.

5. Buying and Selling through the Platform

• The user is responsible for the content of advertisements they post.
• Posting illegal, misleading, or non-compliant content is prohibited.
• View counts and likes are statistical information only and do not constitute a guarantee.
• Completing the transaction requires payment through the platform followed by confirmation of receipt from the buyer.

DownUp does not guarantee the quality of products or services, but only ensures the proper flow of the transaction.

6. Services and Professions

• The professional is responsible for the service provided and its quality.
• Ratings reflect only user opinions.
• Payment is released after confirming service completion.

7. Chat and Agreements

• Chat is available for text messages only.
• Messages cannot be manually deleted by users.
• The platform keeps conversations until the process is complete, after which they may be automatically deleted.
• Some messages may be considered binding agreements for both parties.

8. Payment and Mediation System

• Payment methods include BaridiMob, EUR, USD, and USDT.
• Funds are temporarily frozen until the process is completed and then released to the entitled party.
• The platform is not responsible for external malfunctions or delays from payment service providers.

9. Points and Internal Currencies

• Points and currencies are internal digital elements only.
• They do not represent real money.
• The system can be modified or canceled without prior commitment.

10. Account Suspension or Termination

The platform reserves the right to suspend or terminate any account in case of violation of terms or suspicion of illegal activity, without being obligated to provide justification.

11. Limitation of Liability

The platform is provided "as is" without any warranties. DownUp does not bear any responsibility for losses or disputes resulting from user transactions.

12. Applicable Law

These terms are subject to and interpreted according to the laws in force in the People's Democratic Republic of Algeria, and Algerian competent courts are the sole authority to consider any dispute.
